The Lost Constitution

The Constitution Act, 1867 contains two main provisions—sections 91 and 92—that distributed legislative power between Canada and the provinces. These content of these sections, and the method of distribution based on classes and matters, was not invented at the time of the drafting of the Act. Instead, the content and the method of distribution were taken from the de facto federalism that existed in the province of Ontario before confederation.
